1. Introduction

Welcome to The Practice Platform ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our website at thepracticeplatform.co.za and our meditation, wellness, movement, and in-person class services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Description of Services

The Practice Platform provides:

- A growing library of meditations, rituals, and movement content

- Personalised wellness practices and recommendations

- Monthly subscription access to online content

- In-person movement and wellness classes in Kalk Bay

- Digital wellness resources and materials

3. Membership Plans

Local Membership – R500/month

- Unlimited in-person classes in Kalk Bay

- Full access to the online content library

- Non-refundable monthly subscription fee

Online Membership – R300/month

- Full access to the online content library

- Suitable for members based internationally or who prefer to practise remotely

- Non-refundable monthly subscription fee

4. Account Registration and Eligibility

4.1 Account Creation

To access our Services, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Eligibility

You must be at least 18 years old to use our Services.

4.3 Account Responsibility

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

5. Subscription Terms

5.1 Billing and Payment

- Subscription fees are billed monthly in advance

- Payment will be charged to your designated payment method

- All fees are non-refundable except as required by law

- We reserve the right to change subscription fees with 30 days' notice

5.2 Automatic Renewal

Your subscription will automatically renew each month unless you cancel before the renewal date. You may cancel at any time through your account settings.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to Services until the end of your paid period.

6. In-Person Classes – Kalk Bay

6.1 Bookings

- All in-person classes must be booked in advance through our website or designated booking system

- Bookings are confirmed only upon receipt of payment or valid membership

- Class availability is limited and subject to change

6.2 Non-Refundable Bookings

All class bookings are strictly non-refundable. Once a class is booked, no refunds will be issued under any circumstances, including but not limited to personal illness, change of plans, or inability to attend.

6.3 Cancellations and No-Shows

- If you are unable to attend a booked class, please notify us as early as possible as a courtesy to other members

- No-shows will forfeit their booking without any credit or refund

- We reserve the right to release your spot if you have not arrived within 10 minutes of the class start time

- Bookings cannot be rolled over into the following week. If you need to move a booking, this is permitted once within the same week only, subject to availability

6.4 Class Cancellations by Us

In the unlikely event that we need to cancel a class, we will notify you as soon as possible. No credit, refund, or compensation will be offered in this instance.

6.5 Health and Safety

- You must inform the instructor of any injuries, health conditions, or physical limitations before class

- Please do not attend class if you are feeling unwell

- The Practice Platform and its instructors accept no liability for any injury, loss, or damage sustained during in-person sessions. Participation is entirely at your own risk.

6.6 Conduct

- Members are expected to arrive on time and respect fellow participants and the studio space

- In-person class access is non-transferable and limited to the registered account holder

- We reserve the right to refuse entry to any member whose conduct is deemed disruptive or inappropriate

7. Acceptable Use

You may use our Services for personal, non-commercial purposes only. You agree not to:

- Use our Services for any illegal or unauthorised purpose

- Infringe on the intellectual property rights of others

- Share your account credentials with others

- Upload or transmit harmful, offensive, or inappropriate content

- Attempt to gain unauthorised access to our systems

8. Intellectual Property

All content on The Practice Platform — including meditations, videos, text, graphics, and logos — is our property or licensed to us and is protected by copyright and intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use our Services for personal use only.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers and Limitation of Liability

10.1 Health and Wellness Disclaimer

Our Services are for general wellness and educational purposes only. They are not intended as a substitute for professional medical advice, diagnosis, or treatment. Always consult with qualified healthcare professionals before beginning any wellness programme.

10.2 Service Availability

We strive to provide continuous access to our Services but cannot guarantee uninterrupted availability. We may suspend or discontinue Services for maintenance or other operational reasons.

10.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or attendance at in-person classes.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of our Services, your attendance at in-person classes, or your violation of these Terms.

12. Termination

You may terminate your account at any time by cancelling your subscription. We may terminate or suspend your account immediately if you violate these Terms. Upon termination, your right to use our Services will cease.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts of South Africa.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes acceptance of the new Terms.
